Members of the House of Representatives Commission VII Satya W. Yudha states, the elimination of fuel oil (BBM) subsidy is a violation of the 1945 Constitution (UUD '45), Chapter XIV, Article 33 on social welfare, in particular paragraph 3.
Satya explains, if the premium is removed people will be forced to buy pertamax with prices adjusted for economics, which is regulated by market mechanisms rather than government.
"This is where violations committed by the government, because it was not controlled or controlled by the government, because it has been occupied or controlled the market," he said, Satya said, when contacted Legal, Jakarta, Saturday (30/04/2011).
The contents of UUD'45 article 33 paragraph 3 is the earth, water and natural riches contained therein controlled by the state and used for the greatest prosperity of the people. "The government violated the natural wealth of the article is not controlled by the state again,"he explained.
Satya also added, the discourse should be studied again, because the same was forcing people to buy more expensive fuel costs almost doubled. The price premium currently Rp4.500 while pertamax Rp8.700 per liter. "This is tantamount to raise fuel prices but shy," sindirnya.
Earlier Finance Minister Agustin Martowardojosaid that the the government plans to remove the premium from the fund subsidies gradually and premium products .
"I think the premium should not be transmitted, subsidies first, and then later on premium," said Agus.
According to Agus, the need for written premium in Indonesia because the premium prices currently below the standard. "It needs to (deletion) because it oktannya high premium," said Agus.
